Terms & Conditions
1.0 Pricing:
(a) All 'Classic Safari' ('Suggested Itineraries')
rates are based on two people travelling during
'peak' safari season (May - November) See discounted
rates (5.0.b) All Tailor Made Safari rates are
Quoted based on the time of year / season and
the particular requirements of the client. The
only additional charges / surcharges may be '
taxes or actions of local government'. Some activities
have to be booked & paid locally. (c) Single
supplement charges may occur. (d) Some Safaris
may be quoted in foreign currencies and payments
must be made to us in Pounds Sterling and will
be payable at the prevailing rate at the time
that payment becomes due.
1.1 Rates Include:
Full board and accommodation, internal transfers,
all Game viewing activities i.e. Game drives /
walks, fishing, canoe/cruise safaris etc, most
drinks* at Lodges & Bush camps, Food, Laundry,
National Park fees and local taxes.
1.2 Rates Exclude:
(a) International air fares and travel insurance.
(b) Local departure tax payable at International
Airports for international flights departure tax
for domestic flights. (c) Some activities at Victoria
Falls i.e. Bungee Jumping, White-water rafting,
Abseiling, Micro-light flight. (d) Some imported
Spirits, wines & Champagne.
2.0 Payment:
A 30% deposit is required immediately to confirm
your booking, with the full balance (70%) due
90 days prior to departure. Short notice bookings
( less than 90 days ) are payable in Full to confirm
your booking. Cheque's must be made out to 'Nyanja
Safaris Ltd' or internet Bank Transfers are possible
- Details on request.
3.0 Cancellations by
you: The 'Deposit' payment is fully refundable
up to 90 days prior to departure, after then it
is not refundable. 'Balance' payments are refundable
as follows; 70% 89-60 days; 50% 59-45 days; 25%
44-30 days; 0% (NIL) 29 days prior to departure.
Cancellation payments may be reclaimed through
your travel insurance.
3.1 Cancellations by
us: If your safari or part of safari
has to be cancelled prior to departure or during
your safari, by Nyanja Safaris or the local safari
operator for whatsoever reason (see items 9),
we will contact you to try and offer a similar
safari & trust that you will find it acceptable,
or any payments made to date will be refunded
to you in full. No further compensation will be
given for changes / cancellations as a result
of causes beyond our control.
3.2 Alterations by you:
If you wish to change the arrangements after your
booking has been confirmed, we will do our best
to assist you. However, we can not guarantee that
your alterations will / can be made. We also reserve
the right to charge an alteration fee of £
50.00 per person in addition to any other costs
& expenses incurred by us making or trying
to make alternative arrangements.
3.3 Alterations by us:
Once your safari has been booked we make every
effort to ensure that your safari proceeds as
booked however, Nyanja Safaris or our ground operators
reserve the right to make alterations to the itinerary
at short notice if it becomes necessary for whatsoever
reason. Note this may even happen once your safari
has begun. 'We' will endeavour to keep to the
'spirit' of the original itinerary as booked should
this happen. For example Bush Camp non-availability
due to 'Acts of God' ( i.e. fire, weather - early
rains, political unrest).
5.0 Discounts:
(a) Group Discount will be given for 6 people
or more travelling together, this will automatically
be calculated in your itinerary. (b) Green Season
discounted rates apply between December and April.
(c) Residents Rates for Nationals or 'certified
Residents' of the host country may be available
subject to confirmation. In most cases this amounts
to a considerable saving on International Rates
- please contact us for further details. (d) Children
discounts will be applied when ever they are available.
6.0 Children:
All our safaris are "Family Friendly"
however, as many of the bush camps are very remote,
some camps will only accept children under the
age of 12 years old by prior arrangement - this
is for the children's safety.
7.0 Special requirements:
Any special requirements / needs / diet etc must
be requested in writing by the client at the time
when the booking is made.
8.0 Insurance:
You are required to take out comprehensive travel
insurance at the time of your booking which should
include; cancellation, curtailment, medical expenses
including 'Emergency Medical-evacuation', personal
belongings / baggage / money cover & personal
accident. Please ensure that you are aware of
any 'exclusions' - Your insurance should be sufficient
& suitable for the kind of holiday you are
booking. You must take your insurance policy with
you on your holiday.
9.0 Our Liability:
We accept liability to you, in accordance with
Regulation 15 of the Package Travel, Package Holiday
& Package Tour Regulations 1992 for the proper
performance of our obligations under the contract.
9.1 Your Responsibilities:
(a) It is your responsibility to ensure
that you check the requirements applicable to
you for the country/s that you will be visiting
in good time before you depart and to ensure that
all necessary passports / visa's etc. do not expire
until well after you expect to return. (b) You
must contact your doctor for advice & to ensure
that you are physically fit and comply to the
health requirements of your destination. (c) It
is your responsibility to make yourself available
at the right place and the right time to meet
all your transfers / activities etc - if you are
unsure please check with your ground operator
or guide.
(d) As between you and the 'suppliers'
and any other services which form a part of your
safari their conditions of business will apply.
You may be required to sign liability waivers
or other documentation as required. Example of
such include; White Water Rafting, Horse back
or Canoe safari activities. You must comply and
follow all safety instructions or requirements
as given to you by your guide/s.
(e) It is a condition of your
contract with us that you act with reasonable
prudence and circumspection whilst on your safari
holiday. (f) The 'suppliers' and guides reserve
the right to deny you access to any 'activities'
based on their professional judgement & experience
for safety or health reasons even if you have
pre-paid for any such activity in which case you
will be refunded for such activity in full - excludes
refund to 'inclusive' activities in which case
another suitable activity will be offered. (g)
Disorderly conduct will not be tolerated and the
'suppliers' or Guides reserve the right to take
what ever actions as they deem necessary to control
the situation created by such behaviour. The safety
& enjoyment of ALL their guests is paramount.
(h) You must act within the Local
Law. If you are unsure about anything - please
ask your 'suppliers', Lodge management or guides
for advice.
(i) Nyanja Safaris do not accept
any responsibility if you fail to comply to any
of the above conditions.
9.2 Complaints:
If you are unhappy with any aspect of your safari
while you are away you must register your complaint
to the Management of the relevant safari operator
/ lodge / airline ( supplier) immediately and
to us by telephone, fax or email at your earliest
opportunity. Please insist that the relevant 'supplier'
sends us a copy of your complaint if you are unable
to contact us yourself at the time. If your complaint
is not resolved satisfactorily by the time you
return please let us have full written details
within 14 days of your return.
10.0 "Force Majeure":
A condition of our contract with you is "
Force Majeure". This means occurrence of
unusual and unforeseen circumstances beyond our
control, the consequences of which could not have
been avoided even if due care had been exercised
including but not limited to technical, maintenance
or mechanical problems, flight rescheduling, industrial
disputes, civil strife, war or threats of it,
bad weather, terrorist activities etc. In such
circumstances Nyanja Safaris & our 'suppliers'
will assist in what ever way we are able but can
not accept any responsibility nor provide any
compensation.
11.0 Financial Protection:
Funds paid to Nyanja Safaris ltd from the clients
are held in a 'Trust' Account and your money is
protected and returnable to you in the unlikely
event of insolvency. We are ATOL licensed (6700).
12.0 Bookings:
Your booking is subject to acceptance of the above
terms & conditions.
